SHORT TERM LEGAL CONSULTANCY SERVICES FOR COMPILATION AND PRODUCTION OF REPORT ON REGIONAL CONSULTATIONS, REVIEW AND FINALISATION OF THE PROPOSED PNG EXTRACTIVE INDUSTRIES TRANSPARENCY COMMISSION (PNGEITC) BILL
Extractive Industries Transparency Initiative (EITI) is a global standard that seeks to promote open and accountable management of revenues generated from extractive sector activities. It also seeks to strengthen government and company systems and processes, inform public debate and enhance trust among different stakeholders.
The PNGEITI National Secretariat through its Multi-Stakeholder Group (MSG) is seeking a competent and credible consulting firm or individual with legal background to compile feedbacks and submissions made by stakeholders from the recent regional consultations on a draft PNGEITI Commission Bill and finalise a report from these consultations in accordance with the Terms of Reference (ToR). The consultations were jointly undertaken by the National Secretariat and the State Working Group.
The consultant is also required to review and finalise the draft Bill for submission to Cabinet and subsequently to Parliament for enactment of the law to establish PNGEITI National Secretariat as an independent statutory entity.
This is a short-term assignment and is expected to take approximately four (4) months from December 2021 to March 2022.
The objective of this consultancy services is to develop and produce a full Report on the recently concluded Regional Consultations on the proposed PNG Extractive Industries Transparency Commission (PNGEITC) Bill. The specific activities expected to be undertaken by the consultant to achieve this objective are listed in the Terms of Reference (TOR) which can be accessed from the PNGEITI website at www.pngeiti.org.pg or collected from the National Secretariat office for full details.
The assignment must be undertaken by a legal expert or consulting firm that has experience in legislative drafting for establishment of Statutory institutions or a Commission consistent with the Regulatory Statutory Authorities Act (RSA) and the PNG Constitution. Further, the legal consultant must have a clear understanding and working knowledge on the PNG legislative process, the statutory requirements and the procedures involved in drafting a Bill, securing Cabinet approval and presentation to Parliament.
